A large service company in the transportation industry recently designed an innovative fix to a long-standing and troubling coupling device....The new design was sourced out without restrictions and the firm’s standard terms and conditions were silent on proprietary rights....Additionally, the firm did not have a culture that was sensitive to patent protection....As a result, the innovative device is not an industry standard and does not provide a proprietary competitive advantage to its designer.
